Terms of Service

1. Right to Modify Terms

Hifunnel reserves the right to update, modify, or supplement these Terms of Service at any time. Changes become effective immediately upon posting on the website. Your continued use of the platform after notifications of changes constitutes your acceptance of the new terms.

2. Role of Hifunnel

Hifunnel is a Software as a Service (SaaS) platform that provides you ("Creator" or "User") with the tools to create, manage, and sell digital products, courses, and knowledge services. We provide the technical infrastructure but are not a party to any transaction between you and your customers ("Students").

3. Intellectual Property (IP)

• Your Property: You retain full ownership of all content (videos, text, documents, courses) you upload to Hifunnel. By uploading, you grant Hifunnel a license to host, display, and distribute this content solely to operate the platform.
• Hifunnel's Property: Hifunnel owns all software, source code, interfaces, and core technologies of the platform. You may not copy, resell, or commercially exploit Hifunnel's proprietary code.

4. Creator Responsibilities

• You are solely responsible for the legality of your uploaded content. Content that is illegal, infringes copyright, contains adult material, violence, scams, or unauthorized propaganda is strictly prohibited.
• You are responsible for complying with tax, business, and advertising laws when selling products to your customers.
• Hifunnel reserves the right to unilaterally remove content or permanently suspend accounts without prior notice if these terms are violated.

5. Payments, Fees & Refunds

• Transactions with Students: You integrate your own payment gateways (e.g., SePay, Stripe). Payments from Students go directly to you. Therefore, you are 100% responsible for invoicing, taxes, and handling refund requests or disputes from your Students. Hifunnel does not mediate disputes between you and your Students.
• Hifunnel SaaS Subscription Fees: Usage fees for the Hifunnel platform are billed prepaid on a cyclical basis (monthly/annually). No Refunds Policy: Once you have successfully paid for a subscription plan, Hifunnel does not offer refunds under any circumstances for unused time if you cancel early.

6. Disclaimer of Warranties & Limitation of Liability

The platform is provided on an "as is" and "as available" basis. Hifunnel does not warrant that the service will be uninterrupted or error-free.

Hifunnel DOES NOT guarantee any business results, revenue levels, or success from your use of the platform to sell courses or products.

In no event shall Hifunnel's maximum liability for technical issues exceed the amount you paid to Hifunnel in the most recent month.

You agree to indemnify and hold Hifunnel harmless from any claims, lawsuits, or damages arising from your violation of laws, copyright infringement, or disputes with your Students.

7. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the Laws of the Socialist Republic of Vietnam. Any disputes arising from or relating to the use of Hifunnel shall primarily be resolved through negotiation. If negotiation fails, the dispute shall be submitted to the competent People's Court in Ho Chi Minh City for resolution.
